Current Project Status
We have completed the initial stage of our review that involved a survey being sent out to agencies covered by either of these Acts and other stakeholders. We are currently analysing the responses and doing further research with a view to releasing an issues paper towards the middle of 2010.
What do you think works well and what doesn’t with the Official Information Act (OIA) and relevant parts of Local Government Official Information and Meetings Acts 1987 (LGOIMA)?
Both Acts have promoted a culture of openness in Government but after over 20 years some aspects are problematic and this is exacerbated by the explosion of information technology.

What happens next? The Law Commission will analyse your comments and carry out further investigation and research in 2010. We will publish an Issues Paper in the first half of 2010 identifying problems and proposed options for solutions. We then want to hear your views on our research before finalising recommendations to Government.

Do you agree with the underlying principles and the overarching frameworks of these Acts?
Reasons commonly given for not releasing information include, in broad terms, maintenance of the law, enabling good government, protecting commercial interests, privacy, and processing difficulties.
Almost all organisations that are responsible to central Government in some way are within scope, and most local organisations that are accountable to the public for their function.
This legislation is over 25 years old and whether it is still easy to understand and to follow is an important question.
