More details need to be provided when outlining issues in Public Excluded. Recent example: Invercargill City Council report from a Directorate gave Bluff as the subject. Information was withheld using negotiations as reason. This makes requesting info difficult if not impossible and have to rely on ICC and their word that it should be in PE.

Regular reports should be produced by LG outlining issues put into PE so that Commission or DIA can monitor councils that are excessively using PE.
At present only once a request is made and denied and forwarded to the Ombudsmen are acted on. Some councils are over using PE and regular reporting would highlight those councils without tying up Ombudsmens Office with requests that are frequently over turned. Over turned decisions show that the Council is mis-using the Act.

A difficulty for Local Authoritires in responding to requests - particularly large requests is one of scale and the impact of such requests on limited resources.
There are also very real concerns about application of the Act to LA/s undertaking trading activities being placed at a disadvantage by requests that are made by trade competitors or those who seek to fustrate legitimate activity.
